Eugene Oregon Birth Injury Lawyer

Cerebral Palsy & Hypoxia Attorney OR

Representing Victims of Birth Injuries in Eugene, Oregon

Simply but, a birth injury is any injury that occurs to the mother or the child during the delivery process. Some injuries, such as broken bones or dislocated joints, may heal and cause no permanent damage to the child. Others are far more serious, having a lifelong impact on your child's life.

My name is Robert Miller. I am a medical malpractice lawyer in Eugene, Oregon, with over 35 years of experience handling personal injury cases. If your child has suffered a minor birth injury, consider yourself lucky that your child has a chance at recovery and a "normal" life. Legal representation is typically only necessary when your baby suffers a life-altering injury that will not get better in time.

Examples of serious birth injuries include:

  • Shoulder dystocia, resulting in Erb's palsy: This permanent condition is caused by damage to the nerves in a child's shoulder during the delivery process. Erb's palsy may also be caused by a doctor's failure to perform medically accepted procedures during delivery. Another cause could be failing to perform a caesarean section to avoid the risk of nerve damage if your child's shoulders are too large for delivery through the birth canal.
  • Cerebral palsy: This devastating condition is caused by permanent damage to the nervous system and/or brain. Cerebral palsy could be caused by conditions that predate the actual labor and delivery. In those instances, there is nothing your doctor could have done to prevent it, even if he or she took exceptional care during the delivery. In some cases, however, cerebral palsy is caused by a lack of fetal monitoring during the delivery process.
  • Hypoxia: Hypoxia (brain injury) results from oxygen deprivation during delivery. Proper fetal monitoring will let the delivery team know if your baby is in distress and enable the doctor to take preventive steps such as performing a timely cesarean section.

If you suspect that your child's birth injury was avoidable and caused by medical negligence, I will review the doctor's and nurses notes of the birth process and often consult expert obstetricians. If the injury was indeed the result of medical malpractice, I will do my best to hold the providers and/or hospital accountable and recover the compensation you will need to provide for your child's medical needs.
