Oregon Medical Malpractice Law

Representing the Victims of Medical Negligence

When clients come to my law office to discuss a medical injury, they usually don't know whether the injury was caused by something the doctor or hospital did wrong. All they know is that they or a loved one went to a medical provider for treatment and came out with a catastrophic result like a birth injury, misdiagnosis or surgical error.

I'm Robert Miller, a medical malpractice lawyer in Eugene, Oregon. Doctors and hospitals are often unwilling to talk to patients about something that has gone wrong in a medical procedure. One of the things I do for my clients is get answers. Only after certain questions are answered can we determine if malpractice occurred and whether you have a legal case.

As your lawyer, I work with a network of medical experts who review your medical records and testify that your provider committed malpractice.

What is Medical Malpractice?

A bad medical outcome is not always caused by malpractice. Unfortunately, medical procedures sometimes fail, even if the doctor did everything right and did everything humanly possible to help. If the doctor or other medical professional responded to your condition appropriately, there is no cause of action for medical negligence. Malpractice exists only if the medical provider failed in his or her duty to you.

In Oregon, to prove malpractice, your lawyer must show:

1. Medical negligence: In short, the provider committed a breach in the standard of care reasonable for treatment of your condition.

2. Causation: Your injury was caused as a result of or made worse by the medical negligence.

To be worth pursuing as a legal case, the malpractice must cause significant damage to the victim. Realistically, most medical malpractice cases, if pursued to trial, will cost from $25000 to $100,000 in expenses.
